Present: Mayor McConnell, Councilmen Silbernagel, Spooner, Anderson, Wangler, Sinner, Tillisch. City Attorney Brad Burgum, Public Works Supervisor Kevin Mayer, Cass County Sergeant De Wayne Nitschke, City Engineers Kyle Meyer, Brandon Oye, City Auditor Brandy Pyle. Audience: Amanda Gadas, Lynae Sims, Diane Sporel, Lorne Sterner, Ashley Maasjo Pam and Jim Foss.

Anderson made a motion seconded by Sinner to approve the minutes of December 8; City Attorney's Report, Police Report, Municipal Judge's Report, and the delinquent utilities list. All voted aye on roll call; motion carried.

Silbernagel made a motion, seconded by Wangler approve the following bills, refunds and salaries for the month of January. All voted aye upon roll call vote; motion carried.

The financial report was reviewed departments and Overtime for snow removal was discussed. Anderson made a motion, seconded by, Tillisch to approve the monthly financials. General Fund: $276,910.09; Special Revenue $576,454.20; Debt Service $39,747.87; Construction Fund ($292,609.22), Special Assessment $367,511.68; Enterprise $883,464.82; Trust &Agency $117,802.89 for a total of $1969282.23. All voted aye on roll call vote; motion passed.

No correspondence was received

Lorne Sterner, chairman of the Planning and Zoning Commission presented their recommendations for 2 conditional use permits.

The second request was to have 2 outside employees employed at a daycare located 522 Martins Avenue. Ashley Massjo has a license for a group daycare, which allows her to care for 18 children. City ordinance limits home based daycares to 7 children. All State and County requirements have been fulfilled. City Attorney noted that the zoning ordinance would have to be amended to allow more than 7 children. Silbernagel, made a motion, seconded by Tillisch to approve up to seven children and 1 outside employee at 522 Martins Ave. All voted aye on roll call vote; motion passed.

To change an ordinance it would take two readings. Anderson made a motion, seconded by Spooner to have the Planning and Zoning Commission study this situation, invite daycare providers, and the public to discuss. The commission will also talk to the two latest developers (Dell Arneson, and Martin's Lutheran Church) in town to make sure they are comfortable.

Public Works Supervisor Kevin Mayer presented a list of areas in town where curb and gutter seem to be holding water and not draining. It was noted that not much can be done by the Catholic Church because it is in need of major street repair. The Post Office has a panel of road that has sunk. Fairway and Cottonwood Drives appears to have something wrong with the curbs and could possibly be remedied with sand jacking. City Engineer Kyle Meyer was requested to get cost estimates for repairs on this road, and to resurface too. The Council agreed that the Post Office area should be a priority, as there is a lot of traffic. Mayer and Meyer will discuss the streets and determine the priority.

Mayor McConnell opened the only bid received for the pickup. John Holm bid $1,262.00. The Mayor recommended to reject it. Wangler made a motion, seconded by Anderson to reject the bid for the pickup. All voted aye; motion passed.

Mayor McConnell noted that there were 2 pistols remaining from the dissolved Casselton Police Department. Sergeant Nitschke, Deputies Sprecher and Danielson will check with the County to see what can be done to dispose of the guns.

Spooner made a motion, seconded by Silbernagel to appoint Bernie Sinner, Julie Nelson, Mark Wieland, Brad Morris, and Brad Burgum to 4 year terms to the Casselton Job Development Authority. All voted aye on roll call vote; motion passed.

The Council reviewed the list of records ready for disposal. The prepared list follows the State guidelines for retention and disposal of records. Sinner made a motion, seconded by Silbernagel to approve the disposal of records on the list. All voted aye on roll call vote; motion passed.

The Council discussed the permanent financing for the Swan Creek Diversion. Sinner made a motion, seconded by Silbernagel to approve the resolution authorizing the issuance and sale of $1,931,688 wastewater treatment assessment warrants, series 2009. All voted aye on roll call vote; motion passed.

The permanent financing will replace the temporary financing at 2.5% financing.

The Council discussed a frontage road just going north of the Vet Clinic, an approach and maintenance on the frontage road. The approach has to be installed to service the Vet Clinic and the Lorne Sterner property. The future growth plan of Casselton does not include frontage roads, but it does include back lot roads. The Council agreed that they didn't want a service road. The City will not build a frontage road south of the Vet Clinic access.

Silbernagel made a motion, seconded by Spooner to send a letter will ND DOT regarding the needed approach on Highway 18. All voted aye on roll call vote; motion passed.

The Council then addressed Spring Flooding. Public Works Supervisor noted that the ground is totally saturated. He also noted that we have gravel and plastic to set up on the road if needed. This item will be kept on the agenda for the next couple of months.

Silbernagel made a motion, seconded by Spooner to recognize Team North Dakota Elite (Wrestling) as a public spirited organization and approve a raffle permit. All voted aye on roll call vote; motion passed.

Spooner made a motion, seconded by Silbernagel to recognize the Rural Cass Snowmobile Club as a public spirited organization and approve a raffle permit. All voted aye on roll call vote; motion passed.

Discussion moved to proposed ordinance 253 which amends the snow parking regulations. The snow removal crew is having a hard time getting through streets or not being able to clear all the snow off because of cars parked on the side of the road. The snow parking ordinance committee recommended trying odd/even days year round to help the Public Works clean the streets. Spooner made a motion, seconded by Silbernagel to approve the first reading of ordinance 253. All voted aye except for Tillisch. Motion passed 5-1.

Councilman Anderson reported that the Public Works crew has been working very well. They accomplished two summers worth of work in one this past year. Anderson felt that the City didn't need to hire an additional person, but should reward the City employees for the hard work and dedication. He proposed a percentage increase in salaries and a 1% increase in their retirement. The Council discussed the possibility of disability insurance as an option. Silbernagel made a motion, seconded by Sinner to approve the wage increases. All voted aye on roll call vote. 2009 Salaries as follows: Public Works Supervisor $45,312.00; Assistant Public Works Supervisor $34,079.00; Public Works Laborer I $33,100.00; Public Works Laborer II $32,671.00; Public Works Laborer III $26,732.00; Auditor $41,241.00; Assistant to Auditor $10.82 per hour; Janitor $11.08 per hour; Municipal Court Clerk $97.31 per month; City Assessor $291.03 per month.

Capital Improvements Plan Special Meeting 6:00 P.M.

Present: Mayor McConnell, Councilmen Sinner, Wangler, Tillisch, Anderson, Spooner, Silbernagel. Also Present: Public Works Supervisor Kevin Mayer, City Engineers Kyle Meyer, Brandon Oye, and City Auditor Brandy Pyle. Audience Members: Lynae Sims and Amanda Gadas.

Mayor MConnell opened the meeting.

City Engineer Kyle Meyer reviewed the projects listed in the plan ,proposed cost, funding options and time line for each project.

The Mayor had each of the Councilmen rate their priority for each of the projects.

Discussion on the above projects continued with the details of each project.

Meyer reminded the Council that this is a living documents and it can always be changed as the Council see the need or if an emergency arises.

When asked, City Engineer Kyle Meyer noted that the streets and the roof on the water bubble were the projects he felt from an engineering stand point needed to be addressed first. He also felt the sanitary sewer realignment project would be the next priority.

The Mayor would like to address the street project without a big assessment. He felt a lot of money is used to bond for a project. He would like to see the City borrow money so that money isn't tied up in new bonds every year

The Council didn't see any changes needed in the proposed plan, but would like to have a public meeting to see what residents think. The Auditor will also sent out a survey on survey monkey, a free survey program.

The street gutter issues have not been addressed in the streets plan.

Sinner made a motion, seconded by Silbernagel to present the Casselton Capital Improvement Plan it to the public. All voted aye on roll call vote; motion passed.

Mayor McConnell noted that he has had more complements on snow removal this year than complaints. He commended the Public Works Department for their hard work on a well done job.
